Terms and Conditions
The following terms and conditions pertain to all of Oasis Orchard Technologies’ services. By activating or using the services provided by Oasis Orchard Technologies (“Oasis Orchard”), you confirm that you are of legal age to enter into this agreement and that you have read and fully understand its terms and conditions. These terms create a binding agreement between the customer (“Customer” or “You”) and Oasis Orchard.
1. SUBSCRIPTION
The Customer, as identified in the Customer Account (created in accordance with section 7 herein), subscribes to Oasis Orchard’s services subject to the terms and conditions specified herein.
The Customer is responsible for providing accurate information and for updating any information on their account. Oasis Orchard reserves the right to suspend or terminate the Customer’s account if incomplete or inaccurate information is provided at the time of subscription or any time thereafter.
Customers subscribed to Oasis Orchard’s services are not in a service contract. Customers may cancel services at any time without penalty or cancellation fees. The service and associated charges are subject to change, with notice provided to Customers via email. It is the Customer’s responsibility to ensure their account has an accurate email address to receive updates and notices.
2. 9-1-1 EMERGENCY SUPPORT FOR THE SERVICE
Please read this section carefully regarding 9-1-1 emergency service limitations:
Limited 9-1-1 Emergency Service
Oasis Orchard’s services offer a limited 9-1-1 service that differs from traditional 9-1-1 dialing. Calls may not be handled in the same manner as those made using traditional phone lines.
How 9-1-1 Calls Are Routed
9-1-1 calls may be routed to a Public Safety Answering Point (PSAP) or local emergency service provider designated for the address provided during subscription. Keeping address information up-to-date ensures accurate routing.
Address Information Limitations
Unlike traditional Enhanced 9-1-1 services, Oasis Orchard’s service requires confirmation of your location. If unable to speak during a 9-1-1 call, emergency services will assume you are at the address saved in your account.
Updating Address Information
If you move, you must update your address in your Oasis Orchard account. Failure to do so may result in emergency responders being sent to the wrong location. Updates may take up to three (3) days to take effect.
Limitations of 9-1-1 Service
The 9-1-1 service may not function during power outages, internet failures, equipment malfunctions, service suspensions, or if used outside of Canada. Customers should have an alternative method to contact emergency services.
Liability
Oasis Orchard is not liable for any inability to access 9-1-1 services, including harm resulting from the limitations of the 9-1-1 service. By continuing to use Oasis Orchard’s services, you accept these limitations.
3. SOFTWARE
Software License
At subscription, Customers are entitled to download and use the software required to operate the service. Oasis Orchard grants a non-exclusive, non-transferable, revocable license to use this software, subject to these terms.
Restrictions
Customers may not:
Copy the software except for one backup copy.
Modify, reverse engineer, decompile, or disassemble the software.
Sublicense or transfer the software.
Use the software in a timesharing or service bureau arrangement.
Ownership
All rights, title, and interest in the software remain with Oasis Orchard or the original owner.
4. USE OF THE SERVICE
System Requirements
Customers must ensure their systems meet the minimum requirements to use the service. Oasis Orchard is not responsible for issues arising from inadequate system specifications.
Installation
Customers are responsible for downloading and installing software from approved app stores such as Apple App Store, Google Play Store, and others listed on the official website.
Third-Party Software
Oasis Orchard is not responsible for any third-party software or hardware that may interfere with the service.
5. SERVICE TERM & CANCELLATION
Oasis Orchard’s services are offered without long-term contracts. Customers may cancel services anytime by submitting a support request. Refunds for unused services will be processed in accordance with the Refund Policy available on our website.
6. PRIVACY
Oasis Orchard respects your privacy and handles personal information in accordance with the Privacy Policy available on our website. By using the services, you consent to the collection and use of your information as described in the policy.
7. COMMUNICATIONS/MARKETING
By subscribing to Oasis Orchard’s services, you consent to receiving account-related notifications and marketing communications. Customers may opt-out of marketing emails at any time.
8. LIMITATION OF LIABILITY
Oasis Orchard is not liable for any damages resulting from the use or inability to use the services, except as required by applicable law.
